How to Search Orangeburg County Property Records

The grantor-grantee index is the primary finding tool at the Orangeburg County Register of Deeds. Every recorded instrument appears in both the grantor and grantee indexes by party name. Starting with the current owner's name in the grantor index, you can trace conveyances backward in time to build the chain of title. The grantee index runs forward, showing each time a person received property in Orangeburg County.

The statewide SC Land Records portal at sclandrecords.com provides a free online name-indexed search for documents recorded with participating South Carolina counties. The search returns party names, brief legal descriptions, and reel and page numbers. These reference numbers allow you to request full copies from the Orangeburg County Register of Deeds. The portal is a useful starting tool for remote researchers who cannot visit the courthouse in person.

In person at the Register's office, bring as much information as you can. A parcel identification number, street address, or the names of recent sellers and buyers all help focus the search. For older records, the office may maintain deed books or microfilm. Staff will direct you to the appropriate resources. Copy fees apply for reproductions of recorded instruments.

Orangeburg County has a complex historical records situation. The county was one of the original South Carolina districts established in the 1700s. According to historical research from FamilySearch, land records for Orangeburg County survive from 1868 to the present at the Orangeburg County offices. Records from 1865 to 1868 exist as Orangeburg District records. However, records from 1785 to 1865 were largely lost, with some deeds recorded in Charleston District surviving the destruction. Recording Requirements and Fees

Instruments presented to the Orangeburg County Register of Deeds must comply with S.C. Code Ann. § 30-5-30. Every deed, mortgage, or other instrument must be acknowledged before a notary public or other officer authorized to administer oaths in South Carolina. The acknowledgment certificate states where and when the acknowledgment occurred and bears the officer's signature and official seal. Documents without proper acknowledgment will be returned unfiled.

Section 30-5-35 also requires that deeds and mortgages executed after July 1, 1976, contain a derivation clause. This clause identifies the instrument through which the grantor acquired title, maintaining a continuous paper chain. The grantee's mailing address must appear in the document as well. The base recording fee is $15 for the first page. The deed recording fee of $1.85 per $500 of realty value is collected separately under the authority of the South Carolina Department of Revenue. The state retains $1.30 and the county keeps $0.55 of each $1.85 collected.

Orangeburg County Property Assessment

The Orangeburg County Assessor's Office values real property for tax purposes under S.C. Code Ann. § 12-37. South Carolina requires a countywide reassessment every five years, with a one-year extension available by county ordinance. Act 388, passed in 2006, capped taxable value increases at 15% between reassessments for properties that have not been sold. When a qualifying Assessable Transfer of Interest (ATI) occurs after December 31, 2006, the Assessor reassesses the property at full fair market value for the following tax year. This is a significant consideration for buyers in Orangeburg County, where agricultural and rural tracts may have been capped well below market value for years.

Owner-occupied residences are assessed at 4% of fair market value. Agricultural property qualifying under state law carries the same 4% rate. Commercial and investment real estate is assessed at 6%. Orangeburg County has a large base of agricultural land, and changes in land use can affect assessment ratios. Property owners may appeal assessments under the procedures set by state law.

Note: Changes in agricultural use classification in Orangeburg County can trigger a rollback tax in addition to the reassessment at the higher ratio. Consult the County Assessor for details on agricultural exemption requirements.
